The Special Immigration Appeals Commission (SIAC) was established through the Special Immigration Appeals Commission Act 1997. The function of SIAC is to hear appeals where individuals have been subject to immigration decisions – such as being deprived of their status or excluded from the UK - for reasons relating to the ‘public interest’. Such decisions are often justified on grounds of national security.
SIAC is often referred to as the ‘secret’ court due to the fact that individuals pursuing appeals before SIAC are not privy to all of the evidence against them. This is because the Secretary of State for the Home Department (SSHD) has ‘certified’ that the decision in question is based on evidence which it should not be made public for reasons of national security, international diplomacy, or for other reasons relating to the public interest. Such evidence is given to the court in ‘closed’ proceedings, which are not open the appellants or the public, often by witnesses from the secret services or the National Crime Agency (‘NCA’).
