The SSHD has the power to cancel an individual’s Indefinite Leave to Remain in the UK on grounds of national security, to protect UK relationships with other countries, or otherwise in the public interests. In recent years the SSHD has increasingly been exercising this power to exclude individuals on Serious Organised Crime grounds, as well as national security grounds.
A decision to cancel an individual’s Indefinite Leave to Remain in the UK on national security grounds and/or serious organised crime grounds can only be certified by the Secretary of State for the Home Department and not by staff working at the Home Office. This is different to where decisions are made to curtail leave on grounds that do not include any issues pertaining to national security or public interest.
