A Restricted Certificate of Sponsorship ( RCoS) can only be assigned in the following circumstances:
A request for an RCoS must be made through the Sponsorship Management System and is subject to a monthly allocation process.
Any request for a RCoS is assessed by a panel who sit monthly and points are awarded based on the salary on offer for the position and whether other criteria have been satisfied such as whether the job is a shortage occasion or the resident labour market test has been met. An application must be made by the 5th day of each month in order to be considered by the panel after 10th day of the month.
It is important for a company to ensure that they will be awarded the maximum points they are eligible for when making an application for an RCoS. Particular care must be taken to ensure that the resident labour market test has been undertaken correctly for example and that the salary on offer meets the requirements as specified in the Codes of Practice for Skilled Workers.
