Defending Possession Claims

Landlords have to follow a strict set of legal procedure in order to legally evict a tenant or be granted a possession order. They have two options for seeking eviction or possession, they are;

  • Section 21 notice
  • Section 8 notice

 

If your landlord gives you a section 21 or section 8 notice they will have to be valid. It is possible to dispute the validity of either and if they are found to be invalid the landlord will not be able to force you to leave or repossess the property.

 

You can also defend possession claims if you believe your landlord has or is trying to illegally evict you or is attempting to possess the property illegally. There are many defences to possession proceedings such as defences as a result of counterclaims reducing arrears or it not being reasonable for a possession order to be made by way of example.
