As a landlord, you must follow strict procedure if you wish to evict a tenant otherwise you risk illegally evicting them and you could be prosecuted.
Actions that are considered illegal include;
- Forcing the tenant to leave by making threats or harassing them
- Physically throwing the tenant out
- Preventing the tenant from accessing certain parts of the property
- Changing the locks
You can evict a tenant if they have remained in the property following;
- The end of their fixed term contract
- The end of the period set out in a legal notice to leave
But you must ensure that to serve a valid notice on the tenant and obtain a possession order in court.
