Property related insolvency

Duncan Lewis Litigation Solicitors – Property related insolvency

Duncan Lewis property litigation solicitors can advise both landlords and tenants in property insolvency matters – and can offer assistance to insolvency practitioners (IP) dealing with insolvency related property matters.

Landlords and insolvency

Duncan Lewis can advise landlords on the options available to them if a tenant has become insolvent, including recovery of any rent arrears or other outstanding monies under the lease or tenancy agreement.

In some cases it may be possible to make a claim against a director of a company which has gone into liquidation, as well as claiming against an IP or administrator in an insolvency case.

Duncan Lewis can also advise in cases where a tenant is in arrears with rent and/or payments due under the lease or tenancy agreement and is likely to become insolvent.

Duncan Lewis property litigation solicitors can take swift action to protect a landlord’s interests in an insolvency case – including negotiating with a tenant over debt recovery and guarantees that they will fulfil their financial obligations under the lease or tenancy agreement, as well as issuing a Section 6 notice on sub-tenants who may be solvent.

Duncan Lewis can also advise on termination of leases in insolvency cases and eviction.

Tenants’ insolvency

Tenants who become insolvent or go into liquidation need to take legal advice as soon as possible regarding their lease or tenancy agreement, before a landlord makes a claim against them for debt recovery and takes action to terminate a lease or tenancy agreement.

In cases where sub-tenants are living at a property, a landlord may issue a Section 6 notice on them if they are solvent – Duncan Lewis can advise on action a landlord may take against an insolvent tenant and any sub-tenants, and advise on the options available to the insolvent tenant and their obligations under the lease or tenancy agreement.

Duncan Lewis can also advise on Section 17 notices and Section 19 notices – as well as advising tenants whose landlord has been made bankrupt or gone into liquidation.

In cases where a landlord is seeking to evict an insolvent tenant and is taking action for recovery of arrears, Duncan Lewis can take swift action to protect a tenant’s interests and advise on their options under the Housing Act 2004 or the Housing (Wales) Act 2014.

Duncan Lewis property litigation solicitors can advise IPs at any stage of a bankruptcy or liquidation on a wide range of property related insolvency issues, including advising on landlords who wish to forfeit a lease or enforce the term of a lease on an insolvent tenant, or recover rent arrears or other monies due under the lease.
