Harley Street dentist struck off for serious misconduct (2 December 2015)

Duncan Lewis, Legal News Solicitors, Harley Street dentist struck off for serious misconduct

A Harley Street dentist has been removed from the General Dental Council’s (GDC) list of registered professionals, following allegations of serious misconduct and poor performance.

Tapeshwar Anand – whose registered address was The Dental Implant Centre, 61 Harley Street, London W1 – faced allegations covering several years, including that he failed to adequately discuss treatment plans with patients and failed to discuss the risks of treatments with patients.

It was also alleged that Anand did not discuss the reasons for delay in treatment with patients and did not communicate with the patient’s general dental practitioner (dentist) when deciding and advising on treatment.

It was also alleged that he failed to obtain consent when changing treatment methods.

The allegations against Tapeshwar Anand were heard in public by the GDC’s Professional Conduct Committee (PCC) over the course of several weeks between 4 November and 19 November 2015.

The committee noted the delay most patients experienced in starting treatments – and that they were not kept informed of the reasons for the delay and were left to “chase for” information.

Patients were also ignored – and when a response was eventually provided, the reasons given for the delays were inaccurate.

In reaching their decision, the committee said:

“…[Mr Anand’s} misconduct very seriously undermined public confidence in the dental profession – in particular, informed consent is a cornerstone of the public interest and must be paramount in the mind of registrants prior to carrying out treatment.

“Failure to obtain consent is a serious matter. Your conduct demonstrated a complete disregard for the rights and interests of patients.

While the committee noted the steps being taken by Anand to try to improve, it said:

“Your clinical failings and deficient professional performance have not been remedied – and, as such, there remains a risk of repetition of the behaviour in the future.”

Anand was suspended immediately, but can appeal.

His name will be removed from the register around 28 days’ after the ruling, which means he won’t be able to practise as a dentist in the UK for a minimum of five years.

The GDC is the body responsible for investigating matters when it is alleged that a dental professional's ability, behaviour or health may impair their fitness to practise.
