Notable Cases

High Court
  • NAME OF CASE - Defended and successfully discharged a Worldwide Freezing Injunction brought against our client. A claim was issued against our client for allegations including breach of fiduciary duties, breach of contract and dishonest assistance, amongst others. That same day, a Freezing Injunction had also been made against our client which placed harsh constraints on the client including restricting him from leaving the country and having his passports confiscated by the Claimant’s solicitors. The claim met with numerous difficulties including issues with the assigned court and transferring the proceedings to London and evidential issues. Furthermore, it involved issues with jurisdiction and elements of Afghan law. The Defendant was represented by myself, Leah Kesby and Rachel Upton, we worked diligently and achieved a fantastic outcome in the circumstances. We successfully discharged the Freezing Injunction and received back the client’s passports, we also settled the case in favour of the Defendant’s counterclaim for a substantial six figure sum.

  • NAME OF CASE - Settled a complex Professional Negligence claim recovering costs. I represented the Claimant along with Leah Kesby and William Couchman. Our client had taken early retirement based upon pension figures provided within a settlement agreement offered by his Company. Based upon the representations made, the client accepted the offer and signed the agreement. However the client was informed some months later that the pension figures had actually been incorrectly calculated and he therefore was due to receive a figure substantially less. It was also our client’s case that the solicitor appointed to advise him on the settlement agreement had failed to do so prior to him entering into it. We ought to bring a claim for professional negligence against his solicitor and also a claim for misrepresentation against the actuary firm that had prepared the incorrect pension calculations. We successfully settled the client’s case against both defendants, recovering legal costs and a success fee.

  • NAME OF CASE - A claim involving breach of Data Protection rights. I represented the claimant along with William Couchman. It was the client’s case that the Defendant had breached her data protection rights by unlawfully forwarding her correspondence containing sensitive and personal information to a third party causing her damage and considerable distress, including a claim for defamation being successfully brought against her in the Middle East. At the time, the claimant was domiciled in Iraq and her life became endangered all as a result of the Defendant’s unlawful processing of her personal information. Numerous Without Prejudice attempts at settlement failed and proceedings were issued the day before limitation expired. Soon after exchange of the parties Precedent H Cost Budgets, prior to the CCMC, the Defendant accepted our client’s Part 36 offer. The Civil and Commercial Litigation team were able to successfully settle the case just shy of the total amount claimed, much to the client’s satisfaction after years of distress and fighting for justice.
  • Khosravi v British American Tobacco PLC & Ors [2016] EWHC 123 (QB) (28 January 2016) - High value claim, Solicitor advising the Claimant on preliminary issues in conjunction with a team of lawyers including other law firms and Queen's Counsel. Extensive research on foreign law and applicable law including gathering of formidable evidence to favour. Extended efforts to obtain litigation funding.

    • Kahangi & Ors v Nourizadeh [2009] EWHC 2451 (QB) (09 October 2009) - Lead Solicitor - advising on defamation and foreign jurisdiction. Landmark decision on security for costs obtained through strategic application of the law.
