I am a Solicitor in the Litigation and Public Law teams at Duncan Lewis.
I am very experienced in Court of Protection cases in a wide area of matters. I have acted for incapacitated clients through their Litigation Friend (including the Official Solicitor, RPR's and IMCA's) and I have also acted for family members involved in these proceedings.
My experience in the Court of Protection department includes matters relating to health and welfare including: residence, care, contact disputes and complex matters relating to physical and sexual abuse. I have successfully defended extremely complex and emotive allegations of physical and sexual abuse. I have also represented incapacitated clients in cases that have involved abuse. Additionally, I regularly challenge the rights of individuals who are subject to a deprivation of liberty. I also have experience in making health and welfare deputyship applications and challenges under the Care Act 2014.
I also have a very broad experience in Court of Protection matters which relate to Property and Financial Affairs. My experience includes successfully challenging court appointed deputies on grounds of capacity and / or best interests ; successfully challenging the appointment of an attorney acting under the powers of an LPA and routinely make deputyship applications. I have litigated in complex matters where the high value estate of the individual is in different jurisdictions and also matters involving allegations of financial abuse.
I regularly defend Article 5 and Article 8 rights of incapacitated individuals
I also have experience in general public law having worked and assisted on a number of cases which relate to VAT disputes with HMRC; judicial review of inquest matters, accelerated payment notices/ personal liability notices and breaches of Data Protection.
