I am a Solicitor in the Litigation and Public Law teams at Duncan Lewis Solicitors.
My practice in civil and commercial litigation is broad and I handle cases in the following areas:
Debt recovery and money claims
Contractual disputes (commercial)
High profile litigation
My experience spans from small to medium sized cases to large, high profile matters and multi-jurisdictional claims. I am currently part of a small team involved in a an international strict product liability claim arising from the Grenfell Tragedy. I have a niche practice in complex cases relating to Right to Erasure cases under GDPR.
My clients' financial positions and long term objectives are critical to how I run my cases. I have a methodical approach to all matters that I work on and work closely with clients in achieving their ultimate objective in a proportionate and cost effective way with an aim of achieving the best settlement for all my clients. I encourage the use of Alternative Dispute Resolution (ADR) throughout proceedings.
My public law practice primarily focuses on Court of Protection matters. I have acted for incapacitated clients through their Litigation Friend including the Official Solicitor, Relevant Person's Representatives (RPRs) and Independent Mental Capacity Advocates (IMCAs) and I have also acted for family members involved in these proceedings.
My experience in the Court of Protection department includes matters relating to health and welfare including: marriage, sexual relations, residence, care, contact disputes and complex matters relating to physical and sexual abuse. I have also acted on complex matters which are linked to family proceedings where a Forced Marriage Protection Order in place.
I have successfully defended extremely complex and emotive allegations of physical and sexual abuse. I have also represented incapacitated clients in cases that have involved abuse. Additionally, I regularly challenge the rights of individuals who are subject to a deprivation of liberty. I also have experience in making health and welfare deputyship applications and challenges under the Care Act 2014.
I also have a very broad experience in Court of Protection matters which relate to Property and Financial Affairs. My experience includes successfully challenging court appointed deputies on grounds of capacity and / or best interests ; successfully challenging the appointment of an attorney acting under the powers of an LPA and routinely make deputyship applications. I have litigated in complex matters where the high value estate of the individual is in different jurisdictions and also matters involving allegations of financial abuse.
I regularly defend Article 5 and Article 8 rights of incapacitated individuals.
I have successfully challenged Local Authorities and CCGs by way of pre-action on decisions to reduce care and support provisions.
I also have experience in general public law having worked and assisted on a number of cases which relate to VAT disputes with HMRC; judicial review of inquest matters, accelerated payment notices/ personal liability notices and breaches of Data Protection laws.
