Scarborough County Court has served a civil injunction on 29-year-old rough sleeper for anti-social behaviour (ASB) in Scarborough town centre and seafront in the last 12 months.

Rough sleeper Gavin Wilson has been issued with a list of prohibitions within a designated area of the town and must not keep or deposit his belongings on the ground or on any bench in any public place for a period of more than ten minutes.

For the purposes of the injunction, public place means any place – whether publicly or privately owned – to which members of the public freely have access without first having to pay an entrance fee, or otherwise seek permission.

Wilson is also prohibited from sleeping rough in any public place within the designated area – and cannot sit on the ground in any public place within the area.

He is not allowed to keep or put any rubbish in any public place within the area, except public bins or waste receptacles – and must not place any hat, bowl, bucket or other container or vessel in front of, or near to himself, in such a manner as to attract passers-by to place money in it.

Wilson cannot place any bong, pipe or hypodermic needle – also known as a pin – in a place where it may be visible to a member of the public; and may not urinate or defecate in any public place, except public toilet facilities, provided that they are used only for the purpose of urination and defecation.

Wilson is also prohibited from being in possession of any open containers of alcohol in any public place, or being in possession of any psychoactive substance in any public place.

For the purposes of the order, psychoactive substance has the same meaning as Section 2 of the Psychoactive Substances Act 2016.

He has also been banned from behaving in a way which causes or is likely to cause harassment, nuisance, alarm or distress to any other person.

Scarborough Council Community Safety and Safeguarding Manager, Sandra Rees, said:

“We have worked with our partners to pursue this injunction – and hope that the result will give the members of the public who have been severely, detrimentally affected by the behaviour of Mr Wilson some reassurance and comfort.

“We are not in the habit of bringing action against those rough sleepers who do not cause trouble, but we will not tolerate those whose anti-social behaviour causes distress to others.

“Where we have clear evidence that this is the case, we will take enforcement action.”
