Claimant solicitors have mounted an attack on Government proposals to significantly restrict claims for minor Road Traffic Accidents (RTA).

Under Government plans, injured people would be compensated for some losses such as the cost of medical treatment but claims for “pain, suffering and loss of amenity” will be significantly limited. The reforms also propose restricting the small claims limit for Personal Injury claims to £5,000. In essence, Claimants will not be able to recover legal costs for claims less than £5,000 and will need to represent themselves. How the courts will deal with this flood of “Litigants in Person” is currently unknown.

The Association of Personal Injury Lawyers (APIL) say the emphasis on insurance-based arguments suggests a “fundamental imbalance” in the Governments approach and this is “profoundly unfair” on people who have been injured. Furthermore, “the Government is naïve enough to believe that the savings insurers will make on paying compensation will result in lower premiums”.

APIL backs plans for an outright ban on all pre-medical offers and argues for a ban on cold calling through legislation, as well as action to tackle credit hire, repair costs and storage charges.
