Under new proposals, a foreign criminals “right to family life” could be abolished. Home Secretary, Theresa May, has spoken of plans to revise the immigration rules to prevent the widespread “abuse” of Article 8 of the European Convention on Human Rights. Official figures have revealed that Article 8 was successfully used by more than 100 foreign criminals and illegal immigrants in the last year alone. Prime Minister David Cameron believes that the courts should focus on protecting the UK and less so on a foreign criminal’s right to family life.

MPs are unlikely to be able to vote on the proposal as it is contained in secondary legislation. Home Office sources claim that the new proposals will “rebalance” the current system. While everyone has a right, under Article 8 of the European Convention on Human Rights, to respect for their private and family life, it is not an absolute right. Officials maintain that it is acceptable to interfere with the exercise of that right in order to protect both the public and the British economy.

Mr. Cameron and Mrs. May have both announced their wish to abolish the Human Rights Act and replace it with a British Bill of Rights. However, they are unable to act as quickly as they would wish due to fierce opposition from the Liberal Democrats.
