Homelessness refers to a specific set of circumstances and rights defined by homelessness legislation, primarily under the Housing Act 1996 and the Homelessness Reduction Act 2017. These laws establish criteria for determining whether an individual or household qualifies as legally homeless and outlines the obligations of local authorities in providing assistance.
In the legal context, a person is considered legally homeless if they meet one or more of the following criteria:
1. No Accommodation: They have no place to live, or they are at risk of losing their current accommodation.
2. Insecure Accommodation: They have a place to stay, but it is not reasonable to continue living there due to factors like overcrowding, unsuitability, or risk to health and safety.
3. Threatened with Homelessness: They are likely to become homeless within 56 days, and there is no accommodation available to them.
The legal definition of homelessness is broader than merely having no place to sleep on the streets. When someone qualifies as legally homeless, local authorities have specific legal obligations to provide assistance, including assessing their needs and, if eligible, offering temporary accommodation and support.
The aim of these legal provisions is to prevent and alleviate homelessness by ensuring that individuals in need receive appropriate support, housing, and advice from local authorities.
