Since the Jackson reforms - Personal Injury claims have fallen by 23,000 resulting in a £520 million saving for insurers. One would therefore expect insurance premiums to have reduced since the reforms, yet they seem to be on the rise.

A Times article earlier this year suggests premiums have increased by as much as a fifth in 12 months which made them approximately £115.00 more expensive.

On 17th November we received the news that the government intends to push ahead with raising the small claims limit from £1,000 to £5,000 for all personal injury claims. These proposals were put in motion this time last year with George Osborne claiming that further reforms “ . . . will remove over £1bn from the cost of providing motor insurance. We expect the industry to pass on this saving, so motorists see an average saving of £40-50 per year off their insurance bills.”

The recent government announcement echoed Osborne’s claims. Why is the government so confident that motor insurers will pass any saving on to the motorist? It is clear from previous reforms that the promise to pass on savings is unfounded.

By increasing the claims limit to £5,000 Claimants will find it increasingly difficult to find legal representation. It seems that people who have been injured through no fault of their own are being used as scapegoats for unwarranted increases in insurance premiums. As Louise Ellman, chairwoman of the Commons Transport Select Committee stated “ . . . fraud must be wiped out but the insurance industry must also honour its promises.”
