From Tuesday (01/07/14) courts in England and Wales adopted new guidelines on fly tipping, which could mean larger fines and prison sentences for those convicted of dumping rubbish.

The national guidelines on fly tipping and other crimes relating to harming the environment have been updated to enable courts to jail the worst offenders – or impose fines of up to £3 million.

Less serious crimes involving fly tipping could involve a community sentence or fine, or possibly both.

Fly tipping not only spoils the appearance of the countryside, but can also cause pollution and harm wildlife. In urban communities, fly tipping can cause obstructions, attract vermin and can also undermine the community’s feeling of safety in a neighbourhood.

Hazardous materials which re dumped can pose a threat to public health and safety.

Many fly tippers operate at night – and some cases have involved companies which offer to collect and dispose of waste at a recycle plant or official council rubbish dump for a fee, but which then go on to dump customers’ rubbish.

Last month, a horse from Chessington Equestrian Centre was killed in Claygate, Surrey as a result of a dumped bed frame and mattress blocking a bridlepath, which resulted in the rider having to take their mount onto the road.

Also in June, fly tippers dumped hazardous asbestos in Eastry near Sandwich in Kent, which is being investigated by Dover District Council.

The revised guidelines on fly tipping in England and Wales will apply to anyone over the age of 18.

The guidelines will also be used for sentencing purposes in hearings after 1 July – even if the offence took place before 1 July.

In serious cases, if a defendant is convicted of fly tipping, they might now face a prison sentence.
