The Local Authority would usually send a letter before proceedings in circumstances where the risk to the child does not require an urgent court application. A letter before proceedings would usually be sent to any person with Parental Responsibility.
The letter is a formal written warning that court proceedings concerning the child are likely to be issued should they not engage with the Local Authority and address their concerns.
The letter should set out a summary of the Local Authority’s concerns together with a summary of the support, which has been provided to the care giver. The letter should also address what work the caregiver is required to do and what support will be provided to the care giver to avoid court proceedings being issued. Information in relation to the timescales of when the work is required to be completed by should also be provided.
The letter should also assist the caregiver with information as to how they can obtain legal advice and outline the importance of them seeking legal representation.
The letter should invite the care givers to a pre-proceedings meeting to agree proposals for addressing concerns identified which have led to the welfare concerns. This meeting is referred to as a Public Law Outline meeting also known as a PLO meeting.
