Section 17 of the children act 1989, enforces a duty on the Local Authority to safeguard and promote the welfare of “a child in need” in their area. This occurs by allowing the Local Authority to support, provide accommodation and financial subsistence to families with “a child in need” even If they have no recourse to public funds.
A child will be considered in “need” if they cannot achieve or maintain a reasonable standard of health or development. A child would also come under this category if they are considered to be disabled. A child in need may refer to a child’s mental, physical, and emotional needs.
When a child is considered “in need” the local authority can undertake a Section 17 assessment. A request for the assessment must be made in writing and must outline, the child`s needs and the support which is required.
The assessment will consider a range of matters to include, but not limited to, the developmental needs of the child, whether the parents are able to respond to the identified needs and are the parents able to promote the child`s health and development.
Once the assessment has taken place, a child in need plan will be drafted. A child in need plan will contain the support which is required to be provided to a child and/ or family by children`s services.
