Supposed non-disclosure, including the freezing of assets for High Net Worth individuals
Most divorcing couples decide on a fair division of their accrued wealth on divorce by agreement. However, it’s not unusual for the economically stronger party to attempt to hide assets.
Essentially, the party’s to a divorce must be completely truthful and clear on the issue of accrued wealth because in the absence of all relevant information and documentation evidencing accrued wealth it is impossible to define a fair split.
If one party is found to have hidden accrued wealth the party hiding the assets is likely to be punished by being ordered to pay the other party’s costs and/or by being given a less favourable settlement.
If one party is attempting to hide assets or dispose of assets, the other party needs to act fast and take immediate action.
The effected party might want to seek an order to prevent the disposal of assets and/or to require assets already disposed of to be recovered or obtain a freezing order to prevent the disposal of assets. Alternatively, they might want to obtain a search order to establish to true extent of the assets involved.
