Duncan Lewis is pleased to announce that Director of Public Law and Immigration, Trevor Hatton has been appointed as a fee-paid judge at the First-tier Tribunal of the Immigration and Asylum Chamber (FtTIAC).

Trevor has been with Duncan Lewis since 2012 and leads a team of public law and immigration lawyers at the firm’s Croydon office. With over 17 years’ experience, Trevor has expertise in virtually all aspects of public law including immigration, asylum and human rights matters as well as costs-based issues, children’s welfare, disability discrimination and claims for damages. He specialises in judicial review and Court of Appeal cases and has an in-depth understanding of the European Convention on Human Rights. He has been noted by the legal directory The Legal 500 who listed him as a ‘recommended individual’ in their 2019 edition.

The FtTIAC is responsible for handling appeals against decisions made by the Home Office relating to permission to stay in the UK, deportation from the UK and entry clearance to the UK, as well as dealing with immigration bail applications from people held by the Home Office on immigration matters. Trevor’s expertise in this area of law will be invaluable to the tribunal. He has particular expertise in challenges to the Secretary of State, in relation to the Immigration Rules, asylum clams, the Nationality Immigration and Asylum Act 2002, challenging failures to grant asylum claims and the granting of indefinite leave and applying for committal for contempt of court in view of the Secretary of State’s failure to comply with the terms of a court order. He also has extensive experience successfully challenging decisions made by local authorities and the Legal Aid Agency.

Over the course of his career, Trevor has handled matters appearing before all stages of the judiciary, including the Court of Appeal and the Supreme Court. In 2016, he became only the 50th lawyer in England and Wales to obtain the Immigration Law Advanced Accreditation from the Law Society.

Discussing his appointment, Trevor said;

“I am delighted and honoured to have been appointed as a Tribunal Judge, which is a role I have aspired to throughout my professional career. I am acutely aware of the opportunities which working at Duncan Lewis has accorded me and the extensive knowledge and experience which I have gained during my years here undoubtedly assisted my progress through the decidedly challenging selection process. I very much look forward to upholding and safeguarding the rule of law in a judicial capacity.”

We would like to congratulate Trevor on his appointment, who we know will be an invaluable addition to the First-tier Tribunal’s judiciary.

Duncan Lewis Public Law Solicitors

The Duncan Lewis Public Law department continues to be recommended by Legal 500 with the 2019 edition reporting its 'strong presence in this area of the law, making a particularly dominant contribution in immigration, asylum and prison law.'

The Public law team has experience in all aspects of judicial review claimant work, including obtaining emergency orders and other interim relief to prevent breaches of human rights, following up judicial reviews with actions for damages in both the County and High Court and successfully pursuing judicial review matters to the Court of Appeal and Supreme Court. A particular focus is the team’s work handling cases of the deprivation of British citizenship and deportation threats, with a niche specialism in challenging the treatment of immigration detainees and other marginalised communities.
