£100,000 compensation possible for man given vasectomy in error (7 May 2014)

Date: 07/05/2014
Duncan Lewis, Personal Injury Solicitors, £100,000 compensation possible for man given vasectomy in error

A man who went into hospital for a minor routine urological operation and who was given a vasectomy in error could be in line for an £100,000 compensation payout.

The mistake happened at the Royal Liverpool Hospital in February and although surgeons tried to reverse the vasectomy, the unnamed man is still waiting to find out if he is fertile.

The success rate of reversing a vasectomy is around 55% – however, the vasectomy procedure is 99% effective in preventing an unplanned pregnancy.

The hospital has not released any details about the man, including his age. Personal injury lawyers say that carrying out a vasectomy in error on a younger man who has not already fathered children could cost the NHS as much as £100,000 in compensation.

Medical director of the Royal Liverpool and Broadgreen University Hospitals NHS Trust, Dr Peter Williams, told the Mail online:

“We can confirm a patient who was scheduled to have a different minor urological procedure was wrongly given a vasectomy.

“We have apologised unreservedly to the patient and we are offering him our full support. We greatly regret the distress this has caused him.

“It is our duty in the best interests of the patient to uphold their confidentiality; therefore we cannot provide any further detail without their agreement. This is a serious incident and we are investigating this fully to understand why it occurred and how we can ensure it does not happen again.

“We care for around 90,000 inpatient and day-case patients a year and carry out over 25,000 surgical procedures,” added Dr Williams. “Since 2011, we have had one other never event.”

A surgical procedure carried out in error is known as a “never event”.
