The Health and Safety Executive (HSE) has successfully prosecuted a road marking company, after a worker suffered minor burns after a road marking vehicle caught fire and exploded.

Road marker Neil Higgins from Leighton Buzzard in Bedfordshire was working with a team at Imperial Park in Hartcliffe in June 2013, when the road marker being used suddenly exploded.

Mr Higgins suffered burns as a result – and HSE investigators found that gas-heated cauldrons situated on top of the road marker vehicle were not suitable for the work, because the pipe work was not properly connected and the equipment had no flame failure devices.

The investigators also found that the pipe work on the road marker had not been fitted by a competent person.

On Wednesday, 8 October at Bristol Magistrates’ Court, Redland Road Marking Ltd of Hillside Road, Leighton Buzzard in Bedfordshire pleaded guilty to breaching Regulation 4(1) of the Provision and Use of Work Equipment Regulations 1998. The company was fined £2,000 and ordered to pay £1,123 in costs.

Regulation 4(1) of the Provision and Use of Work Equipment Regulations 1998 states:

“Every employer shall ensure that work equipment is so constructed or adapted as to be suitable for the purpose for which it is used or provided.”

After the hearing, HSE Inspector Helena Tinton said:

“This is not the first time there has been a fire of this nature on a road marking vehicle – and the operators need to ensure that the equipment has been installed by a competent person and regularly maintained.

“It is a matter of good fortune that nobody died as a result of this incident.”
