Duncan Lewis, Personal Injury Solicitors, Landscape gardener ordered to repay £5,000 for shoddy work

A gardening contractor who charged nearly £5,000 for shoddy landscaping work carried out at private residences has been ordered to repay £4,490 in compensation to customers.

Gateshead Council prosecuted Adrian Mark Brown of Willow Green, Felling in Gateshead – who carried out work at five properties in Gateshead in the summer of 2016.

The value of the contracts ranged from £600 to £4,250 and included decking, paving and laying turf.

Brown advertised on Facebook using the names Ady Paving Brown and AMB All Trades – he took money up front for materials and did some of the work, but did not finish any of the jobs and the work that was done was so poor that customers had to pay for it to be redone.

Brown was prosecuted for five offences under the Consumer Protection from Unfair Trading Regulations 2008 for contravening the requirements of professional diligence.

He was summonsed to attend Gateshead Magistrates’ Court on Monday 9 January, but failed to attend and a warrant was issued for his arrest.

He was arrested on 11 January and the case was then heard.

Brown pleaded guilty to the five offences and was ordered to pay compensation totalling £4,490 to his victims and £300 in costs.

Gateshead Council’s Service Director, Development Transport and Public Protection, Anneliese Hutchinson, said:

“Consumers have a right to work that is carried out with reasonable care and skill – if unprofessional work is carried out, traders can be prosecuted and this case shows that the courts take the matter very seriously.

“Gateshead Council Trading Standards Service has recently partnered with the Business Approval Register and we would therefore advise consumers to use the Register to find competent trades people to undertake work”.
