The family of Formula 1 test driver Maria De Villota are considering taking legal action over her death, after the Health and Safety Executive (HSE) said earlier this week that it would take no action against Marussia for the crash.

Marussia folded in 2014 and BBC News reports that Manor Grand Prix Racing – which operated Marussia and now operates the Manor team – has declined to comment on the HSE's decision, or the possibility that Ms de Villota’s family might make a claim over her death.

Maria De Villota was injured in July 2012 when the MR-01 racing car she was driving hit a support truck. She lost an eye in the crash and died a year later after initially recovering from serious neurological injuries, which it is reported eventually contributed to her death.

On the day of the crash, it was the first time Spanish-born Ms De Villota had driven the car for Marussia. She had been driving at 200mph, but was travelling at a much lower speed when the incident occurred.

After the crash, she was cleared to drive again in 2013, despite losing her right eye.

After the HSE announced its decision not to take any enforcement action, Ms De Villota’s family said:
“To date, we are still waiting to see the contents of the report and therefore the findings of the investigation, which are crucial to learn from.
“As soon as we have seen the report, we will analyse this in order to evaluate the next legal steps to claim the corresponding civil compensation from those responsible, in order – as Maria herself always wanted – to ensure that accidents of this type never happen again.”
