Duncan Lewis Solicitors has secured damages settlements for two clients (BNE and PER), after the Home Office agreed to settle their GPS electronic-tagging case.

 

Officials backed down shortly before the Court of Appeal hearing was due to be heard. The appeals concerned a claim for breach of our clients’ Article 8 ECHR rights.

 

The Home Office required the clients to wear GPS-tracking electronic tags, as a condition of immigration bail.

Duncan Lewis solicitor Angelo Monni said: “This was a ground-breaking appeal and this represents a significant victory for our vulnerable clients. The Home Office had acted unlawfully, unfairly and disproportionately by imposing these requirements on them. We are very pleased that our clients have now been able to secure a just outcome.”

 

As well as paying our clients sums to settle the appeals, the Home Office also agreed to delete permanently the trail data derived from the GPS tracking for the periods to which the appeal related.

 

The Court of Appeal case followed an earlier High Court claim on behalf of these and two other clients regarding GPS electronic tagging, which resulted in the Home Office paying damages settlements in respect of all four clients.

 

Duncan Lewis brought the appeal on behalf of BNE and PER, in relation to limited parts of their claim that did not succeed in the otherwise-successful initial High Court challenge. The Court of Appeal settlement means they will now receive further compensation from the Home Office, following and in addition to that already received regarding the underlying High Court claim.
