Gabor Nagy, an esteemed Director within our business immigration team, represented a client employed by NT Ltd, a Hungarian haulage company. The client had been imprisoned by UK Border Force (UKBF) after 6,999,200 cigarettes with a total revenue of £2,921,690 had been illegally smuggled inside of the lorry. The lorry and trailer were seized by UKBF and by HMRC investigators. They had refused to give the vehicles back to the Client, asserting that the vehicles formed part of a criminal investigation and were thus evidence which were meant for destruction.
Gabor, under the instruction of the Hungarian haulage company, submitted a civil claim under the Customs and Excise Management Act 1979 (CEMA) for UKBF to return the lorry and trailer to the company (restoration) free of charge. After some back and forth the reviewing officer had eventually decided that the lorry and trailer should be returned free of charge in light of the representations received.
