The Ministry of Justice (MoJ) has this week announced new measures to prevent failed asylum seekers going into hiding in the UK to avoid being deported.

In the future, asylum seekers will not be told of the result of their asylum appeal at the same time as the Home Office, as is currently the case.

A spokesman for the MoJ said:

“This amended procedural rule allows for the first-tier and upper tribunals to serve a final decision notice on the Home Office for onward service on the appellant, as they do with other types of asylum appeal decisions.

“This will enable the Home Office to consider any additional arrangements that may be necessary when serving the decision on the appellant – such as taking measures to prevent the parties absconding or ensuring the vulnerable receive additional support.”

The delay in advising asylum seekers of their appeal ruling means there will, in effect, no longer be a period in which they can abscond from immigration officials to escape being deported.

The Home Office will in the future advise failed asylum applicants of the outcome of their appeal – with the result that some may be detained immediately by immigration officers, pending deportation from the UK.
