Duncan Lewis Solicitors has been featured in Chronicle Law for its involvement in a landmark Supreme Court case, which ruled that the Home Secretary unlawfully deprived the daughter of a UK national of her citizenship. The case, led by Fahad Ansari, Consultant Solicitor in our Immigration and Public Law team, focused on the wrongful refusal to recognise the daughter (ZA) of a stateless individual as British, despite her father being a UK national prior to her birth.
In late February, the Supreme Court unanimously held that the Home Secretary acted unlawfully in refusing to recognise ZA as British. This decision overturns earlier rulings and establishes that the deprivation order should be treated as having no effect from the outset, aligning with the UK’s obligations under international law. This victory holds potential for children in similar situations across refugee camps and detention centres worldwide. It is hoped that the Court’s decision will create avenues for children in analogous or worse positions in detention camps in Syria and Iraq and refugee camps in Turkey and Lebanon to be repatriated to the UK.
