Duncan Lewis, Housing Solicitors, £16,000 fine for planning breach involving tenanted property

Hounslow Council in west London has prosecuted a homeowner for failing to comply with a planning enforcement notice.

Jahanara Salik from Eastbourne Road in Feltham was found to be using a side extension on her property as two self-contained, open-plan studio flats, which were housing tenants.

Despite lodging a failed appeal to the Planning Inspectorate in 2014, Mrs Salik failed to comply with the notice and was taken to court by Hounslow Council.

Mrs Salik has been ordered by Feltham Magistrates’ Court to pay a £13,000 fine, £120 victim surcharge and £3,000 in council costs, bringing the total to £16,120.

Cabinet Member for Community Protection at Hounslow Council,
Councillor Sue Sampson, said:

“We don’t issue enforcement notices lightly. They are issued because there is a reason for the property owner to take action – those who fail to take this action will always face the harshest of penalties.

“For too long, unscrupulous landlords have tried to make money from blatant breaches of planning laws.

“Let this prosecution serve as an example to anyone thinking of doing the same – we will always take the toughest action against you for the sake and safety of our residents.”
