Hotels EVICTING homeless amidst the coronavirus outbreak is UNLAWFUL

On 24 March 2020, the Ministry of Housing, Communities and Local Government announced via Twitter that all hotels, hostels and B&Bs providing rooms to support people who are homeless through arrangements with local authorities and other public bodies – this taken to include emergency accommodation for homelessness applicants – should remain open and are not affected by the Government guidance to close as a matter of necessity.

However, it appears that some hotels, including Travelodge and Comfort Inn, have taken it upon themselves to ignore this guidance. We have seen cases whereby people being accommodated in those hotels, under emergency measures, have had notes posted under their doors giving them very short notices to leave and find alternative accommodation or face street homelessness because those hotels are shutting their doors.

Make no mistake, this is unlawful.

There is a pressure of gargantuan proportions now on local authorities to find emergency accommodation for homelessness applicants in light of the coronavirus (covid-19) pandemic and the severe health risks that are attributable to that virus. This is even more so considering government guidance on self-isolation and social distancing. Of course, for the street homeless or those being kicked out of emergency accommodation by hotels, it is difficult to envisage how they are going to be able to follow the guidance and, therefore, their health is being put at risk. Unfortunately, it appears that the local authorities are now running out of options.

David Miller, an advisor from the Welwyn Hatfield Citizens Advice Bureau, has said the following on the recent developments:

“It is appalling news that hotels for homeless persons are closing against Government guidance and forcing homeless people onto the streets where they are vulnerable to coronavirus, cannot self-isolate and suffer from health conditions which may affect their immune systems and make them more susceptible than most to the illness. We urge local housing authorities to put pressure on the hotel managers and insist they remain open to save lives.”

W rzeczywistosci okazalo sie, ze niektóre hotele (Travelodge, Comfort Inn) wziely sprawy w swoje rece i zdecydowaly sie zignorowac ogloszenie Ministerstwa. Znane sa przypadki gdzie ludzie tymczasowo zamieszkujacy w tych hotelach, czesto jako natychmiastowy i pilny przypadek, otrzymali zawiadomienia z wypowiedzeniem zakwaterowania wcisniete pod drzwi zadajace natychmiatowego opuszczenia lokalu i znalezienia lokalu zastepczego albo beda musieli opuscic lokal pod przymusem i na ulice, bo hotel musi zamyknac dzialalnosc.

Takiego typu dzialania i praktyka jest nielegalna
