Duncan Lewis, Crime Solicitors, £3,700 penalty for Sheffield construction company after waste contractor fly-tips building waste

Sheffield City Council’s Environmental Protection Service has prosecuted a construction company for disposing of waste irresponsibly.

The council decided to prosecute RM City Construction Ltd after two loads of building waste were found by an officer from the Environmental Protection Service on land at Skye Edge field, off Manor Laithe Road in Sheffield.

The waste consisted of timber, wooden cabinets, plastics, cardboard, a bath, windows, tiles, plaster and rubble – as well as ash, food waste and several items of correspondence.

Investigations led to an address in Sheffield where some building work had been carried out by RM City Construction Ltd.

The company was invited to attend for a formal interview, but initially declined – and only engaged with the investigation when summoned to court.

It was then explained that the construction firm had used a private individual to dispose of the waste – but had not carried out any checks as to where the waste might end up.

At Sheffield Magistrates’ Court, RM City Construction Ltd of Mount Street in Sheffield was fined £3,000, with £342 in clean-up costs and £368 in legal costs.

After sentencing, Sheffield City Council’s Cabinet Member for the Environment, Councillor Bryan Lodge, said:

“The council works hard to keep Sheffield clean, with staff sweeping the streets, working in the city’s parks and across housing estates.

“While we accept that RM City Construction Ltd did not tip the waste, the company did not take steps to ensure that its ultimate destination was appropriate.

“We hope that this sends out a signal to other companies to ensure their waste arrangements are legitimate.”

Sheffield City Council added that, in the last year, the council had issued ten Fixed Penalty Notices for fly-tipping, totalling £3,000 and had also issued 30 Fixed Penalty Notices for other waste offences, totalling £1,600.

The council has also taken 12 other waste offence cases to court successfully, resulting in a total of £4,800 in fines and £3,530 in costs.
