A couple accused of performing a sex act during a concert in London’s Hyde Park in September 2014 are to face a retrial, after an Old Bailey jury failed to reach a verdict.
Lisanne Beck, 47 and Simon Murphy, 48 from Swansea in South Wales are charged with outraging public decency.
The couple were attending a concert hosted by BBC Radio 2.
They deny the charge, but will face a retrial which is likely to begin in August, the Evening Standard newspaper reports.
The jury at the Old Bailey was discharged on Friday (12/06/15), after the nine women and two men spent three-and-a-half hours deliberating without reaching a verdict.
The trial had lasted for three days and is estimated to have cost around £20,000 in court time.
The prosecution told the court that the act the couple had performed would be no offence in the privacy of their own home, but “not in Hyde Park in the middle of a concert”.
An onlooker had filmed to the couple. Who were lying on the grass during the concert. A teenager had to be protected from the sight of the couple, who were asked to leave the event.
