A man convicted of grievous bodily harm has had his sentence reduced after the man he assaulted died after two years in a coma.

London newspaper the Evening Standard reports that Michael Broom, 52, from Chessington was sentenced to three years in jail for an attack on retired BT engineer Mark Haley at Hook in Surrey in August 2011.

Broom launched an attack on Mr Haley after he accidentally bumped into his bike while out fetching milk from his local Tesco. Broom punched him to the ground, after tearing off his shirt outside the store. Mr Haley fell backwards and hit his head – an injury which left him in a persistent vegetative state until he died in August this year, after two years in a coma.

Broom was then re-charged with manslaughter and on 22 December 2014, an Old Bailey judge increased his sentence by a further two years.

However, the very next day, Judge Richard Horne QC admitted that when he increased Broom’s sentence, he had failed to take into account that he had already spent 31 months in jail – and reduced the additional sentence to one year.

It is reported that at the time of his attack on Mr Haley, Broom was already known as a “violent bully” with 16 previous convictions for violence and alcohol-related offences. He had also absconded from a bail hostel.

However, Broom could now be freed from jail within six months.

Mr Haley’s family have said they feel “let down” by the justice system – and were nervous about what happen when Broom is released, as he lives near the family.
