Duncan Lewis, Crime Solicitors, European Court of Human Rights upholds convictions of failed London bombers

The European Court of Human Rights has ruled that four men convicted of a failed plot to bomb London Transport on 21 July, 2005 should serve their sentences.

Out of the four convicted men, three are Somali nationals – Muktar Said Ibrahim, Ramzi Mohammed; and the fourth, Ismail Abdurahman, has British nationality.

Abdurahman was convicted of assisting one of the failed bombers and claims that he has been denied his human rights to a fair trial because a witness statement he provided was used in court to convict him, rather than a statement given as a suspect in the plot.

The four men were later convicted of involvement in the failed bomb plot, but all four claim that their convictions are “unfair” because of the statements given without access to a lawyer, which had been used at their trials. The three Somali nationals had each tried to detonate bombs.

Judges at the European Court of Human Rights in Strasbourg ruled that because of the “exceptionally serious and imminent threat to public safety” at the time of the failed bomb plot, the police decision to delay access to legal representation had been justified.

The attempt to set off explosive devices on London Transport took place just two weeks after the 7/7 attack in London on 7 July 2005, which also involved explosive devices on buses and the Tube during the early morning London rush hour.

The 7/7 attack resulted in 52 people being killed, with many more seriously injured and some passengers sustaining life changing injuries.
