14-month jail term for causing death by careless driving (7 November 2016)

A motorist who was under the influence of alcohol and drugs when his car collided with a wall has been jailed for 14 months, after he pleaded guilty to causing the death of his passenger by careless driving.
On 3 June 2014, Jamie Wharton, 30, from Brierley Hill in Birmingham was the driver of a Nissan Skyline GTR. In the car was also 24-year-old Timothy Pearson, who was in the front passenger seat.
The court heard that the defendant drove his car at speed along St Peters Road, Netherton, carrying out dangerous overtaking manoeuvres. As a consequence of his dangerous driving, Wharton lost control of his car, colliding with a garden wall of a residential property.

Wharton was taken to the Queen Elizabeth Hospital by paramedics, but Mr Pearson died at the scene.
An analysis of the defendant's blood established that, at the time of the collision, he had alcohol, cocaine and cannabis in his system.
Wharton pleaded guilty at Wolverhampton Crown Court to causing death by careless driving.
Senior Crown Prosecutor from West Midlands Crown Prosecution Service, Emily Lenham, said:
“Jamie Wharton was driving a high performance car while under the influence of alcohol and prohibited drugs.
“He drove at speed and carried out dangerous and inappropriate overtaking manoeuvres – and it was during one such overtaking manoeuvre that he lost control of his car and collided with a wall, killing his passenger, Timothy Pearson.
“This prosecution shows the tragic consequences of driving at speed when under the influence of alcohol and drugs.
“Our thoughts are with the family and friends of Mr. Pearson.”
