As a treatment, radiotherapy is an extreme course of action used to treat cancer. In this case, a man diagnosed with a treatable brain tumour was given nearly double the recommended dose of radiotherapy leading to a life changing brain injury.

Anyone diagnosed with cancer feels vulnerable, no matter the circumstances. In this instance the man was only 19 years old when he found out about his condition. He was told that the brain tumour was treatable and was sent to Christie Hospital in Manchester to begin radiotherapy.

The man was left with limited mobility and dexterity, as well as problems with his sight, memory and speech after receiving an overdose of radiotherapy.

Twenty years later, his claim has finally been settled in the sum of £7 million, which was delivered alongside an apology for the “disastrous error” from Philip Havers QC, on behalf of the Christie NHS Foundation Trust.

This sort of claim is a claim for clinical negligence for brain injuries and there are many different factors to take into account when such a case is pursued.

Due to the complex nature of the injury, the long-term consequences may not be evident for some time and it can be difficult for doctor’s to assess the extent to which a patient has been affected by their brain injury.

Overtime, a brain injury claimant may show improvement or deteriorate further, meaning the costs of their care could become more expensive, which would lead to an increase in the compensation they are entitled to.

The settlement in this case will take into account the life-long care costs which the Claimant will incur.

In pursuit of the claim, the man’s parent’s persevered to secure a financial settlement which would support their son, even when they were turned away by previous clinical negligence solicitors.
