A man who suffered negligence during his birth is set to receive nearly £8 million from the NHS in compensation.

The man, now in his twenties, was born prematurely, and despite being upside down, medics failed to take the option of a Caesarean-section delivery. As a result of the negligent handling of his birth, the man now uses a wheelchair and requires 24-hour care. In addition to being unable to walk, the man has limited use of his hands, and his intellect is impaired.

The compensation order was made by Mr Justice William Davis at the Royal Court of Justice, London. Although the man is able to feed himself and speak well enough to make himself understood, the judge explained that he is “wholly dependent on others for most aspects of daily living.”
The man will receive a total of £7,928,140, which includes £300,000 for “pain, suffering and loss of amenity”, almost £1.2m for loss of earnings, and more than £2.6m for travel, transport and equipment costs.

Additionally, the man will receive just over £290,000 a year for the rest of his life. If the man lives into his seventies, as expected, the total pay-out could be more that £20m.
