In this episode, our awarding winning family and child care team unpick some of the complications and sensitivities involved in these frequently emotionally fraught legal issues.
Care Proceedings are initiated by a local authority when its believes that a child is at risk of harm or suffering significant abuse, but cases such as these are rarely straightforward. This typically takes place when it is believed that the child cannot remain safely with their parent or carers due to these concerns.
Hosted by Duncan Lewis Directors Kathy Walker and Emily Wright from our Child Care team, this episode features guest Barrister Karen Kabweru-Namulemu from 1GC, who helps provide further clarity on the process.
The aim of care proceedings is to determine what action is in the child’s best interests. In some cases, this can mean placing the child in foster care, with a relative, or potentially pursuing adoption. If the clients are unhappy with the decisions made during the proceedings, they have legal option available to challenging the court’s decision and seek alternatives, which is something we discuss in the episode.
Our Child Care team has extensive experience in helping families navigate the complexities of care proceedings. We understand that these proceedings can be emotionally and mentally exhausting for all involved. She represents parents, children, and other family members in court proceedings including applications for various orders including; care orders, special guardianship orders, child arrangement orders. Emily represents the children both directly or through the guardian, Outside of proceedings, she also advises clients regularly on a number of family and child care issues especially assisting parents where the local authority is involved.
