If you require removal of your gall bladder, your doctor may recommend a procedure called a Laparoscopic Cholecystectomy. A claim for clinical negligence may arise in such cases because the bowel has been perforated during surgery. If this occurs, you may need further surgery which may also result in additional scarring.
There are other possible causes for such a claim; for example, damage may be done to the organs surrounding the bladder such as bile duct injuries, injury to the bowel or injury to an artery causing internal bleeding. If any of these are not identified in time, it could even lead to a fatality. To successfully bring a clinical negligence claim, you need to demonstrate that you have suffered from a substantial injury as a result of negligent treatment received from a medical practitioner either within the last three years or you discovered the negligence in the last three years.

You must demonstrate a duty of care was owed by the medical practioner and that they have acted in such a way so as to breach that duty of care.
