The world is now a much smaller place and modern society has become more mobile. People from different countries, cultures and backgrounds are marrying and connecting and as a consequence children may be moved between jurisdictions. Very often, the parents reach an agreement however in some circumstances, children are abducted or removed without a parent’s consent.
This is where we can help. This area of law is extremely specialised and advice should only be sought from an experienced family lawyer. Not every family lawyer will be familiar with the ever changing international laws. Duncan Lewis act quickly where there is a threat of a child being removed from the UK to any country including non-Hague which may involve abduction for the purposes of forced marriage in another jurisdiction or female genital mutilation, which will usually involve working with the police and border agencies. We can advise on applying to the High Court to make a child a ward of the court in such circumstances. We also act for applicants in cases where the children have been brought to England. We have considerable expertise in bringing about a swift resolution in parent child abduction cases and returning the child to the custodial parent.
Legal Aid is available in child abduction matters, although some instances subject to a means and merits assessment.
