The Court of Protection is responsible for assisting people that never had or no longer have the mental capacity to make decisions. The Court ensures that vulnerable persons cannot be exploited, and that those responsible for their welfare are assisting appropriately.
The Court of Protection can assist in decisions about the health and welfare of an individual, their property and financial affairs.
If you have a case concerning a health and welfare matters, it is possible to apply for legal aid. For cases in relation to Deprivation of Liberty Safeguarding Orders, non-means tested Legal Aid is available for the person proceedings relate to. If you think yourself, or the person proceedings relate to, may be eligible please contact us for an assessment of eligibility.
In relation to property and affair matters, legal aid funding is not available. Additionally, it is not available for applications relating to Lasting Powers of Attorney and Deputyship, generally speaking.
