The Court, having considered the lack of guidance available on the issue of legal aid which must be available in a civil contempt matter, gave guidance on the true meaning of the various complex regulations supporting LASPO 2012.
By action of s16 of LASPO 2012, the Defendant in a civil contempt case in the High Court was entitled to criminal legal aid, which could be granted by a representation order before the Court. By action of the regulations this grant was neither means nor merits assessed. Both the CRM14 form for legal aid and the supporting regulations in the matter, were less than helpful and the LAA agreed to review these documents.
