Duncan Lewis, Reported Case Solicitors, Akpinar, R (on the application of) v The Upper Tribunal (Immigration and Asylum Chamber) [2014] EWCA Civ 937

Court of Appeal – Challenging decision to refuse Art 8. ECHR Deportation appeal – Considering effect and application of ECtHR case of Maslov

Court of Appeal held that there are no special factors that apply where the deportation of a lawfully present migrant who entered the UK as a young child is considered.

Previously the well-known ECtHR case of Maslov had been taken to require that 'very serious reasons' were required to justify deportation in these circumstances. Duncan Lewis seeks permission to appeal to the Supreme Court.
