Duncan Lewis, Legal News Solicitors, £89,000 penalty for safety failings and inadequately guarded machinery at insulation manufacturer

The Health and Safety Executive (HSE) has prosecuted a Rhyl-based insulation company, after safety failings in the processing of hemp and inadequately guarded machinery at the company’s manufacturing plant.

HSE investigators found that Natural Insulation Ltd – formerly called Black Mountain Insulation Limited – had failed to conduct an adequate risk assessment for the processing of hemp used in their insulation products, as well as not providing adequate safety guards on machinery.

The Health and Safety Executive launched an investigation into the company, after concerns were raised anonymously – HSE inspectors concluded that the firm’s COSHH assessment was not suitable or sufficient.

At Wrexham Magistrates’ Court, Natural Insulation Ltd – formerly at Tir Llwyd Industrial Estate, Kinmel Bay in Rhyl, North East Wales, pleaded guilty to breaching Regulation 11 of the Provision and Use of Work Equipment Regulations 1998 (PUWER), as well as Regulation 6 of the Control of Substances Hazardous to Health Regulations 2002.

The company was fined £30,000 and ordered to pay costs of £59,000.
