The Health and Safety Executive has successfully prosecuted a woodworking firm, after an employee broke both legs after a fork-lift truck accident.

In August 2012, at Spa Laminates Limited of Leeds, the fork-lift truck was involved in an accident during a lifting operation.

The fork-lift hit a stack of boards, which knocked into a worker, who then fell onto a second stack of boards, which fell onto a second worker – with the result that one employee broke both his legs in the incident.

The Health and Safety Executive launched an investigation into the incident and decided to prosecute Spa Laminates.

At Leeds Magistrates’ Court, Spa Laminates Limited pleaded guilty to breaching Section 2(1) of the Health and Safety at Work Act 1974.

Section 2 of the Act – General duties of employers to their employees – states:

It shall be the duty of every employer to ensure, so far as is reasonably practicable, the health, safety and welfare at work of all his employees.

Spa Laminates Limited was fined £8,000 and ordered to pay costs of £7,438.
