The Health and Safety Executive (HSE) has prosecuted a food manufacturer after a worker’s hand was partially de-gloved after becoming trapped in machinery.
In February 2015, the unnamed worker was employed at Thomas of York Ltd of Helmsley in York – and was working on a production line when his hand was drawn into machinery manufacturing pastry lids.
He suffered several fractures to his fingers in the incident and an HSE investigation found that the machinery had been modified to “improve” its operation, including removing parts of the guarding system.
When the modification was removed because it was ineffective, the guards were not replaced, the Health and Safety Executive investigation discovered.
On Tuesday 12 April at Northallerton Magistrates’ Court, Thomas of York Ltd pleaded guilty to breaching Regulations 11 and 14 of the Provision and Use of Work Equipment Regulations.
The company was fined £6,500 with £691.45 costs.
After the hearing, HSE inspector Julian Franklin said:
“Modifying machines should always involve a reassessment of the safety of that machine.
“Guard checking routines should be periodically audited to ensure they remain effective.”
