The Health and Safety Executive (HSE) has successfully prosecuted a chemical site operator and electrical contractor, after an employee suffered electrical burns.
On 30 July 2012, Stephen Moore – a 29-year-old employee at Holmes E & M Services – was installing a power monitoring module.
A decision was made to drill in to the rear of the control centre he was working in – but this caused an electrical flashover which burnt a hole in the cubicle back-plate, causing burns to Mr Moore’s hands, arms and face.
Bayer Crop operates a top tier COMAH (Control or Major Accident Hazards Regulations) electrical plant – which has additional duties attached, aimed at controlling risks associated with major hazards.
An HSE investigation into the incident found that neither company had provided a suitable risk assessment or suitable control measures regarding the job.
HSE inspectors concluded that adequate supervision and a safe system of working could have prevented the incident.
At Norwich Crown Court, Bayer Crop Science Limited and Holmes E & M Services Limited both pleaded guilty to breaching Section 2(1) and 3(1) of the Health and Safety at Work etc Act 1974.
The firms were fined £25,000 each – and both were ordered to pay £11,407 in costs.
