Duncan Lewis, Legal News Solicitors, Southwark Council prosecutes food outlets for dumping commercial waste

Southwark Council has prosecuted the managers of a branch of the Subway food outlet and a KHF Chicken takeaway for dumping commercial waste on the streets of Southwark.

The franchisee company of Subway in Walworth Road, Zaf Ambitions, and company secretary, Ms Tharani, were ordered to pay £2,350 and £1,050, respectively.

The court heard that, despite numerous warnings and fines from the council’s enforcement team, they continued to illegally dump commercial waste on the high street outside of their shops.

The owner of KHF Chicken shop, Mr Murad Choudhury, was also ordered to pay £6,050 at a recent hearing at Camberwell Magistrates Court for similar repeat offences.

Southwark Council has prosecuted a total of 12 businesses so far in 2015 –
and handed down fines from the Magistrates court totalling more than £25,000.

After the hearing, Cabinet Member for Communities and Safety, Councillor Michael Situ, said:

“Local businesses have a duty to dispose of their trade waste responsibly.

“Littering pavements not only causes an obstruction to local people, but is unsightly and costs the council hundreds of thousands of pounds a year to clear up.

“Residents and responsible businesses have told me they are fed up with rogue businesses treating our high streets like their personal dumping ground – and I share their frustration.

“I’m glad to see the magistrates are treating these cases as seriously as we do – and are now issuing hefty fines to reflect the seriousness of the crime and the cost to the council such behaviour incurs.

“The message to irresponsible traders is simple – we will now prosecute anyone dumping on our streets using the full force of the law.

“If they haven’t already got an appropriate commercial waste agreement in place, they need to get one quickly…”
