Cornwall Council’s Planning Enforcement Team has successfully prosecuted a landowner for non-compliance with a Breach of Condition Notice.

Robert Tillett – the owner of 24 Riverside Avenue in Newquay – was prosecuted for non-compliance of a Breach of Condition Notice requiring him to erect privacy screens on two balconies that had been granted planning permission at the property.

At Truro Magistrates’ Court on 26 April 2017, Tillett was found guilty of the continuing offence of non-compliance with the Breach of Condition Notice.

Magistrates imposed a £660 fine, with a £66 victim surcharge – and also ordered him to pay the full council costs of £1,677.

The council’s Enforcement Group Leader, Jon Drew, said:

“The non-compliance with a Breach of Condition Notice is a criminal offence – and the Planning Enforcement Section are committed to prosecuting persons who do not comply with these notices.

“In this case, the landowner has to pay a fine and costs of £2,403 – and it shows that these matters are taken seriously.”
