A new data system has been launched to enable personal injury (PI) lawyers to check their clients’ backgrounds for any previous history of fraud.

The askCUE personal injury service was launched on Tuesday (05/05/15) and will be compulsory for all PI lawyers from 1 June.

The system has been launched in response to allegations by some insurance companies that growing numbers of personal injury claims are fraudulent.

The project is led by the Association of British Insurers, the Law Society, The Association of Personal Injury Lawyers (APIL) and the Motor Accident Solicitors Society (MASS).

Solicitors have in the past responded to allegations by insurance companies that some claims are fraudulent by saying that they are unable to check whether a claim is fraudulent with being able to access insurers’ client records.

Law Society chief executive Catherine Dixon told the Law Society Gazette:

“This new system means the legal profession and the insurance industry can crack down on fraudulent claims.

“The collaboration between lawyers and insurers is a huge step forward, showing that we can all work together to achieve a common objective which will benefit consumers.”

Increasing numbers of fraudulent whiplash claims and “crash for cash” claims have been blamed in part for the rise in motor insurance premiums, as the cost of paying out compensation in fraudulent claims is passed on to the motorist.
