A man who made his neighbour’s life a misery through anti-social behaviour has been made subject to an Injunction, after Wirral Council’s Anti-Social Behaviour Team took action against him.
Keith McDonald, 36 – an owner occupier of Seafield Road in New Ferry – was found guilty of harassment and intimidation against his neighbour, through making loud and excessive noise inside and outside his property.
Mr McDonald on occasions would leave his radio on continuously for days when he was not even at home.
After an investigation by Wirral Anti-Social Behaviour Team and unsuccessful attempts to resolve the matter, an application for an Injunction was made.
At a full hearing held at Liverpool County Court on 7th March 2016, Mr McDonald admitted a catalogue of allegations.
An Injunction was made until further order of the court, together with a Power of Arrest – which remains in force until 4pm on 6th March 2018.
If a breach of the Injunction is proven, Mr McDonald could face a term of imprisonment of up to two years and/or a fine.
After the hearing, Wirral Council’s Cabinet Member for Neighbourhoods, Housing and Engagement, Councillor George Davies said:
“Mr McDonald's neighbour has been subjected to sustained harassment that has caused them great distress.
“Mr McDonald has previously failed to comply with a noise abatement notice – and failed to change his behaviour following a Formal Warning and a Harassment Warning in June 2015.
“This action was absolutely necessary and proportionate given the impact of Mr McDonald's unacceptable behaviour towards his neighbour.”
